Will It Be Jail for Lindsay After Betty Ford Controversy?

Actress Lindsay Lohan is in the hot seat once again after an employee of the Betty Ford Center, where she is currently in a court-ordered stay, accused her of assault after an alleged drunken encounter.

Lindsay LohanWhile Lindsay has denied the allegations, and her accuser, Dawn Holland, has been fired by Betty Ford, the question remains: what is in store for the young actress after this episode? She is, after all, still on probation in a DUI case, and this new development, if proven, constitutes a violation of her probation.

According to a feature on People.com, Los Angeles Superior Court Judge Elden Fox had threatened Ms. Lohan with more jail time, if she is found to be in violation of her probation.

Richard Hirsch, a criminal defense attorney in Los Angeles who is not involved in the case, told People.com: “If the latest allegations are true, it just spells disaster for Lindsay… After all the chances she’s had, the judge may have no other option left.”

The feature recalled Lindsay’s failed drug test from a couple of months back, where she was spared more jail time by Judge Fox, who was convinced that what Lindsay needed was further treatment from her self-admitted addiction. She was instead ordered to stay at the Betty Ford Center until January 3.

Steve Sitkoff, another Los Angeles criminal attorney, said: “Judge Fox isn’t one to make idle threats… Especially if he decides that Lindsay was the instigator in the scuffle with the Betty Ford employee, that’ll make him more likely to punish her with jail instead of treatment.”

Did Lindsay Lohan Sneak Out of Rehab to Get Alcohol?

Lindsay Lohan has been out of commission career-wise, but she is still manages to stir up controversy. The troubled star is in the news once again after an employee of the Betty Ford Center, where Ms. Lohan is currently staying on orders of the court, said that the actress allegedly assaulted her during an altercation.

Lindsay LohanA feature on People.com shared that the Betty Ford employee – chemical technician Dawn Holland – was fired within minutes after a video interview of her giving an account of the incident, along with a copy of her report, was posted on TMZ.com

The Betty Ford Center issued the following statement: “Regrettably, one of our employees violated strict confidentiality guidelines and laws by publically identifying patients in a media interview and by disclosing a privileged document.”

Holland alleged that Lindsay and two other patients “snuck out” of the Center to go drinking. A technician reportedly caught by a technician as they tried to “jump over the back wall” to the clinic house that they lived in. Holland was then asked to give them Breathalyzer tests.

It was at this point that Holland and Lohan allegedly had an altercation. Holland described the actress as “very angry and out of control.”

Holland recounted that Lindsay refused to submit to a Breathalyzer test all night, and that she had the smell of alcohol on her breath.

Shawn Chapman Holley, lawyer for Ms. Lohan, gave the following statement: “We are declining to comment on the underlying facts surrounding this incident, as we await the completion of the police investigation. It should be noted, however, that it was Ms. Lohan who called 911 to request police assistance at the time this incident occurred.”

Rehab Gets in the Way of Lindsay Lohan’s Movie

While it will certainly be better for Lindsay Lohan to focus on herself and on permanently getting her life on track, there are trade-offs and sacrifices that she had to make in order to do that. According to recent reports, the young actress will no longer be playing the role of Linda Lovelace in the movie “Inferno,” even if she already shot preliminary stills for the movie.

Lindsay LohanPeople.com shared that Watchmen star Malin Akerman has been chosen to play the role of Lovelace, replacing Lohan.

Chris Hanley, producer of “Inferno,” gave the following statement regarding the decision to replace the actress: “Lindsay had scheduling issues due to legal obligations and is continuing to focus on getting better in rehabilitation in Palm Springs, and she really had to focus on that in our opinion – and hers… for herself and her career in general it was really her decision to just focus on getting better psychologically.”

When Lindsay started having legal problems, the people behind Inferno had stood by her. Unfortunately, an extension of her stay in rehab reportedly prompted the replacement. They were also said to have found it hard to get insurance for the actress.

Lindsay Lohan is currently in a “sober living facility” affiliated with the Betty Ford Center in Rancho Mirage, California. Her stay in rehab has been extended to January 3, at the very least. It can be recalled that when Lindsay got out of jail and rehab early, she failed random drug testing. From that view point, it would seem that the decision to extend her stay in rehab is best over-all.

Of Akerman, Hanley said: “Malin was passionate to take this challenge of the role to task, and we feel she has the talent to meet that challenge.”

Lindsay Lohan Talks to Vanity Fair About Personal Struggles

A few days after her recent sentence was handed down, actress Lindsay Lohan gave an interview to Vanity Fair and talked about, among other things, alcohol and drugs. A feature on USA Today showed excerpts of the interview with the magazine, which is included in an issue that has Lindsay on the cover, due to hit newsstands on September 7.

lindsay lohanOne of the things that the actress says may have led to what can only be described as a series of unfortunate events in her personal life is being around the wrong sort of people. She also denied being an alcoholic, or abusing prescription drugs – something that her dad Michael Lohan had hinted at, to say the least, quite a few times. She told Vanity Fair: “If I were the alcoholic everyone says I am, then putting a [scram] bracelet on would have ended me up in detox, in the emergency room…”

Lindsay also said that while she does admit to “dabbling in certain things and trying things ’cause I was young and curious and thought it was like, O.K., ’cause other people were doing it and other people put it in front of me,” she denies ever abusing prescription drugs, nor having the desire to do so.

The interview inevitably included questions about her father Michael, and Lindsay reacted to the fact that he gave an interview immediately after attending her probation hearing.

There is one thing that Lindsay is confident about, however: “I don’t care what anyone says. I know that I’m a damn good actress.”

Lindsay Lohan Leaves Rehab!

Lindsay Lohan has been released from rehab, according to a post on the Los Angeles Times. The actress was originally ordered to spend ninety days in rehab, but has been released from the Ronald Reagan UCLA Medical Center after staying for only 22 days. Prior to her stay in rehab, Lohan served 13 days out of a ninety-day jail sentence.

Lindsay LohanMs. Lohan’s release from rehab, however, is accompanied by conditions released by Los Angeles County Superior Court Judge Elden S. Fox. Fox ordered that Lindsay undergo intensive outpatient therapy for the next three months, which will include regular counseling and the need to stay in Los Angeles County. She will also be under supervised probation during this time.

The actress will have to comply with the following conditions: that she remain in Los Angeles Country for the duration of the supervised probation, that she undergo random drug testing twice a week, that she undergo psychotherapy four times a week and meet with counselors five times a week. Should Lindsay fail or miss a drug test, it will mean jail time for 30 days.

Lindsay’s lawyer Shawn Chapman Holley shared the following update with reporters after the hearing on Wednesday, where Judge Fox clarified the terms of the actress’ probation: “She has changed… She’s healthy, she’s clear-headed, she’s positive.”

Holley said further that her client’s early release was based on the fact that doctors concluded that there was no further need for Lindsay to stay in the facility: “They started their own fresh evaluation, put her through their own testing and recognized that there was no need for her to be there any longer.”

Lindsay Lohan Up for Early Release from Rehab?

Lindsay Lohan may not need to finish the full ninety days of rehab required of her, according to a post on RadarOnline.com. That certainly is nice to hear, but we can only hope that this is not being done prematurely and that the actress is truly free from whatever excesses she may have in her system.

Lindsay LohanThe revelation was said to have come from prosecutor Danette Mayers, prosecutor for Ms. Lohan’s case. RadarOnline.com shared the following statement from Mayers: “My understanding from conversations with Shawn Chapman Holley is that Miss Lohan could be released early from the treatment facility. It is looking as if that is what the health care professionals are going to recommend. How much earlier she could be released I’m unsure of at this point.”

Mayers indicated that she will adhere to what health care professionals will recommend for Ms. Lohan, which may include follow-up treatment.

Lindsay Lohan was sentenced to ninety days of jail time and rehab in July by Judge Marsha Revel, due to violating the terms of her probation. She was said to have missed alcohol education classes required of her as part of her probation on charges of drunken driving and cocaine possession leveled against her in 2007. Judge Revel has recused herself from the case.

She only served 13 days out of her ninety day sentence due to overcrowding. Lindsay then entered rehab at the UCLA Medical Center.

Shawn Chapman Holley, Lindsay’s attorney, told RadarOnline that Lindsay “looks healthy” and “is looking forward to returning to work.”
